The exceptional immunity that Israel has enjoyed for decades has placed international law and its institutions at the end of the knife. Israel killed UN workers, banned UNRWA, banned UN representatives from entry, and repeated UN and his officials.
The successive Israeli government and its allies use all means to put pressure on the International Criminal Court (ICC) so as not to investigate Israel’s crimes. The attack on the court was enhanced only after the arrest warrant to Benjamin Netanyahu and former Defense Minister Yoh Galanto.
The US President Donald Trump, the eager supporter of Israel, has already signed a presidential order to re -introduce the sanctions on ICC staff. This is the other decision he made, including the Paris climate agreement and the withdrawal of the United States from the World Health Organization, which constitutes direct attacks on international multilateralism. On Tuesday, the US President showed that the United States has completely ignored the international law by declaring the intention of “taking over and owning” Gaza.
All of these developments are questioning whether the UN’s current global system is beyond salvation.
(Despite being created in 1945 to “save the generation leading from the tragedy of war”, the United Nations has almost failed to prevent dispute and stop for decades. We have been led by the agent in the colonial era before being led by the era of “peace for some people.” Do you give up the ideas of legal order completely?
Facing a rapidly dangers of climate change and the rapid escalation of militaryization, it is clear that a system is needed under the ideal of justice. International legal order that does not support powerful people has already been proposed by various thinkers.
For example, Chile’s prominent lawyer Alejandro Alvares proposed a “new international law” about 70 years ago. During his employment judge (1946-1955) as a judge in the International Court, he deals with legal issues in places in the United States, which are based on many international laws. He claimed that it was inadequate.
In a series of oppositions when he deliberated, Alvares responded to specific historical moments of colonization around the world, and reflects the interests and status of the country of decimation. I called.
At that time, the state of Global South had a clear attempt to assert the interests of international law. Nevertheless, the state, which has advanced economically, has eradicated such attempts using its effects.
We are currently in a historic period in which these efforts have to be updated to survive international legal order. Gaza’s Geno Side symbolizes the larger pattern of dominance and exploitation defining the current world system, so the behavior of Palestine may become a driver.
There is already a global South state to eliminate Israel from the United Nations. The petition signed by 500 law scholars has called for the UN General Assembly to exclude Israel to maintain its legitimacy.
In response, the US Congress sent a letter to Secretary Antonio Gutless, who threatened to withdraw US funds if such a voting proceeded. The US lobby power in the United Nations is not a secret, but when executing normal functions, the public threat of withdrawing funds from the United Nations is a form of economic forced institutional authority and international facilities. Law.
If the United States decides to reduce funds to all of the United Nations, there is a clear response. Move the United Nations outside the United States and the fortress Europe and move to a global southern part. Relocating the United Nations headquarters from New York will significantly reduce costs, promote global South support, and enable more powerful participation. It will abolish the dilemma of an international legal institution in a state that has been proved to be the most consistent perpetrator of the crime created by the institution.
At the institutional level, history clearly shows the need to abolish institutional structures that protect the power of the Empire, such as the UN Security Council, the International Currency Fund, and the World Bank. The demands for the abolition of these institutions were at the forefront of the major numbers of the integration movement, such as Thomas Sankara and Amirker Cabral. As a global South voice platform, the United Nations General and International Court of Court must be blessed with more power. This was repeatedly claimed by Algeria’s Judge Mohamad Bejawii. In addition, this can be a moment of rapid international legal production based on historical efforts to create new international legal order. The Pacific Islands have already challenged the limits of international law by seeking the role of national responsibilities for climate change.
Progressive International, a coalition of progressive organizations around the world, has recently tried to revive past efforts by launching a project to develop a new international economic order. The unification of voices is powerful, and global South people are united in economic and physical control and conquest experience. In order to cause such a change, it is necessary to match even if the political tide is only for a moment.
The current moment of Genocide, new colonialism, climate crisis, and unpleasant disclaimers impose the obligation to reconsider the status quo. The irony is something we can’t afford. We need to start the foundation of a new international law system that finds virtues in justice, not power.
